Terms of Service
In plain language
This is the agreement between you and Capt’ns Log for using the app. We tried to write it in plain English without legal jargon.
The short version: the app is free to download and includes a private fishing journal. Some features are part of a Pro subscription with a 14-day free trial. The app gives predictions based on weather and water data; you alone are responsible for decisions about going on the water. We do not run analytics or sell your data; the Privacy Policy has the full picture.
Who we are
Capt’ns Log (“the app”, “we”, “our”) is an iOS application developed by Joe Benscoter. For questions about these terms, contact:

What you can use the app for
- Personal, non-commercial use.
- Do not reverse-engineer the app, scrape our APIs, bulk-extract data, or resell access.
- Do not access the app with bots or other automated tools.
- Do not upload photos you do not have the rights to, or any content that is illegal, infringing, or harmful.
- Do not try to access other users’ data.
What we provide and what we don’t promise
This is the most important section. Read it carefully.
- Capt’ns Log gives you predictions and recommendations based on environmental data from third parties (NOAA tides and currents, USGS water services, Open-Meteo weather and marine). Forecasts and scores are predictions, not facts.
- Third-party data can be delayed, incorrect, or unavailable. We do not control these sources and do not guarantee their accuracy.
- You alone are responsible for decisions about going on the water. This includes boating, wading, surf fishing, coastal fishing, cold-water fishing, and fishing in remote locations.
- Always verify conditions with official sources directly before you go: NOAA marine forecasts, US Coast Guard warnings, local weather services, and your own observation of conditions on the water.
- Carry appropriate safety gear (life jacket, communication, layers for cold water). Tell someone where you are going and when you will be back.
- Follow all applicable boating, fishing, and access regulations. The app may show stale or incomplete information about local rules.
- The app is not a substitute for boater education, fishing licenses, or safety equipment.
Your content
- You own the catches, photos, notes, and fishing spots you create in the app.
- You grant us a limited, non-exclusive license to store, back up, and sync your content across your devices for the sole purpose of operating the app for you.
- We do not sell, share, or use your content for any other purpose. See the Privacy Policy for full details.
- You can delete individual entries or your entire account at any time (see “Termination” below).
Service availability
- We work hard to keep the app available and accurate, but we do not guarantee uninterrupted service.
- We may modify, suspend, or discontinue features or the app itself. We will try to give reasonable notice for material changes that affect paying subscribers.
- The app depends on free third-party services (NOAA, USGS, Open-Meteo). If those go down or change their terms, parts of the app may stop working temporarily.
Updates
- We may release app updates that add features, fix bugs, or change behavior.
- Older versions of the app may stop working over time as servers, APIs, and iOS itself evolve.
Termination
- You may stop using the app at any time.
- You can delete your account in Settings, Delete Account. Deletion is permanent and removes your catches, saved locations, photos, and authentication record.
- We may suspend or terminate accounts that violate these terms or applicable law.
Disclaimers and limitation of liability
- The app is provided “as is” and “as available”, without warranties of any kind, whether express or implied.
- We do not warrant that the app or its forecasts will be accurate, complete, uninterrupted, or fit for any particular purpose.
- To the maximum extent permitted by law, our total aggregate liability to you for any claim arising from or related to the app is limited to the amount you paid us in the 12 months before the claim arose. If you have not paid us anything, our liability is limited to fifty US dollars.
- We are not liable for indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of fishing opportunity, or any damages related to your use of forecasts or recommendations.
- Some jurisdictions do not allow these limitations; in those places, our liability is limited to the extent permitted by law.
Governing law and disputes
- These terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules.
- Any dispute arising from these terms or your use of the app will be brought in the state or federal courts located in Los Angeles County, California. You and we both agree to that venue.
- We do not require binding arbitration. We do not require you to waive your right to participate in a class action.
Changes to these terms
When we make material changes to these terms, we will:
- Update the “Last updated” date at the top of this page.
- Note significant changes in the change history section below.
- For changes that materially affect paying subscribers (pricing, what is included in Pro), notify you in the app on next launch.
Continued use of the app after a change means you accept the updated terms.
Change history:
- 2026-05-24: Initial version.
